Terms and Conditions 2025

These General Terms and Conditions describe the general rules and regulations for the rental and letting of the holiday villa ‘Villa Cela’, located at Calle Peral 14, 03724 in Moraira, Costa Blanca, Spain.

Payment and Reservation

Deposit:

• The deposit consists of 30% of the total rental amount and a security deposit of € 1,000.
• The total amount must be paid within 5 working days of signing the rental contract to the designated bank account, stating your name and rental period.

Confirmation of Reservation:

• The booking will be confirmed upon receipt of the deposit, the security deposit and the agreement signed by the tenant.

Payment:

• The remaining 70% of the rental amount must be paid no later than 8 weeks before the day of arrival to the designated bank account, stating the name and rental period.
• If the booking is made within 8 weeks before arrival, the total rental amount and security deposit must be paid in full and immediately.
• If the tenant has not paid the total rental amount and security deposit as described above, the landlord reserves the right to unilaterally terminate the rental agreement.

Cancellation:

• If the tenant has not paid the total rental amount and deposit as described above, the landlord reserves the right to unilaterally terminate the rental agreement.

Cancellation Policy:

• The landlord expects the tenant to take out cancellation/travel insurance.
• If this is not done, it is the responsibility of the tenant.
• In the event of cancellation, the following terms and conditions apply:
• * for cancellations up to 12 weeks before the day of arrival:
• 100% refund of the total rental amount including deposit, with the exception of €250 administration costs
• * for cancellations from 12 weeks before the day of arrival up to 6 weeks before the day of arrival:
• 50% refund of the total rental price and the total deposit.
• * for cancellations from 6 weeks before the day of arrival to 5 weeks before the day of arrival:
• 40% refund of the total rental price and the total deposit.
• * For cancellations from 5 weeks before the day of arrival to 4 weeks before the day of arrival:
• 30% refund of the total rental price and the total deposit.
• * For cancellations from 4 weeks before the day of arrival to 3 weeks before the day of arrival:
• 20% refund of the total rental price and the total deposit.
• * For cancellations from 2 weeks before the day of arrival until the day of arrival, no refund will be made except for the deposit.
• The landlord will transfer the applicable amounts to the bank account designated by the tenant within 5 working days.

Security deposit:

• The mandatory security deposit is €1,000. This amount is intended to cover any damage to the rented property and its contents.
• The security deposit will also be used to settle any energy costs and the costs of any additional requests made by the tenant.
• This amount will be refunded, less any damage and/or settlement of the above, within 5 working days after the end of the rental period to the bank account designated by the tenant.

Final cleaning:

• The mandatory final cleaning fee is €250 per stay.

Check-in and check-out

Check-in:

• Check-in takes place on the day of arrival between 3:00 p.m. and 8:00 p.m. local time.

Check-out:

• Check-out takes place on the day of departure before or no later than 11:00 PM local time.

Early Check-In or Check-Out:

• Times can be adjusted at the request of the tenant. Adjustments are always subject to availability and approval by the landlord.

Responsibilities Tenant

Villa Cela is suitable for 8 guests. For additional guests, the tenant must submit a request. This request requires the approval of the landlord.

Occupancy:

• Approval will only be granted if it is included in the rental agreement signed by both parties.

Conduct:

• The tenant and his or her guests are expected to behave respectfully.
• Causing nuisance in any form is strictly prohibited.
• If it appears that the tenant and his or her companions do not meet these expectations, the landlord has the right to terminate the rental agreement immediately and without any form of refund, resulting in immediate eviction.

Maintenance and cleanliness:

• The tenant must keep the property in good condition and immediately inform the landlord of any problems or damage.

Use of property

Non-commercial use:

• The property is for private use only. Commercial use or subletting is strictly prohibited.

Pets:

• Pets are not allowed, unless prior permission has been granted.

Smoking:

• Smoking is not allowed in the rented property.

Heated pool:

• The swimming pool can be heated on request at an additional cost of €200 per week.

Energy:

• The total rental price includes energy consumption up to 300 kWh per week.
• Additional consumption will be charged at EUR 0.50 per kWh and deducted from the deposit.

Water:

• Both kitchens are equipped with a water filter system, providing safe and clean drinking water.

Bed and bath linens:

• The total rental price includes the use of bed linen and towels, as well as pool towels.

General:

• In southern countries, disruptions to water, electricity and internet services are more common than you may be used to.
• The landlord cannot be held liable for any damage or inconvenience.
• Electric cars cannot be charged from the mains without the landlord’s permission.

Liability

Property damage:

• The tenant and his or her companions are jointly and severally liable for any damage caused to the rented property and its contents during their stay. The costs of repairs or replacement will be deducted from the deposit.
• Additional costs may apply if the damage exceeds the amount of the deposit.

Injury:

• The tenant and his or her companions are responsible for their own safety and well-being during their stay.
• The landlord is not liable for any injury or accident on the premises.

Personal property:

• The landlord is not liable for loss, damage or theft of the tenant’s personal property

Contingencies:

• Your reservation may be cancelled by the landlord in the event of unforeseen circumstances, such as, but not limited to, forest fires, floods, etc., which, in the opinion of the landlord, render the rented property unsuitable for rental.
• In this case, the landlord will refund any payments already made by the tenant.

Complaints:

• Despite all efforts, it is possible that something may not be in order. In that case, please contact the landlord immediately.

Privacy and Data Collection

Personal Information:

• By booking with us, the tenant agrees to provide accurate personal information.
• This information will only be used for bookings, communication and legal purposes.

Data security:

• The landlord will take appropriate measures to protect the tenant’s data.

Changes

• The landlord reserves the right to change these General Terms and Conditions at any time.
• Changes will be published on our website www.villacela.com.
• By continuing to use the site or services, you accept the updated terms and conditions.

Applicable law

• These General Terms and Conditions are governed by English law. All disputes arising from the use of our services are subject to the jurisdiction of the courts in the nearest city or province.
